Terms of Service

1. Acceptance of Terms

Welcome to CULTURECAST! By accessing or using our platform, applications, website, and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service. These Terms apply to all visitors, users, and others who wish to access or use the Service.

2. Description of Service

CULTURECAST is a modular AI platform designed for brands and agencies to generate, analyze, and deploy culturally intelligent content at scale. The Service includes AI-powered tools, workspaces, analytics, and other functionalities as may be offered from time to time.

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. User Responsibilities and Content Handling

You are responsible for all content, data, and information that you upload, generate, store, or share on or through the Service ("User Content"). You retain ownership of your User Content. However, by using the Service, you grant CULTURECAST a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content solely to the extent necessary to provide and improve the Service.

You agree not to use the Service to create, transmit, or display User Content that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;
  • Infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party;
  • Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.

CULTURECAST has the right, but not the obligation, to monitor and edit or remove any User Content. CULTURECAST takes no responsibility and assumes no liability for any User Content posted by you or any third party.

5. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of CULTURECAST and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of CULTURECAST.

6. Service Usage and Restrictions

You agree not to misuse the Service. For example, you must not, and must not attempt to, use the Service to:

  • Probe, scan, or test the vulnerability of any system or network;
  • Breach or otherwise circumvent any security or authentication measures;
  • Access, tamper with, or use non-public areas of the Service, or shared areas of the Service you have not been invited to;
  • Interfere with or disrupt any user, host, or network, for example by sending a virus, overloading, flooding, spamming, or mail-bombing any part of the Services;
  • Access or search the Services by any means other than our publicly supported interfaces (for example, “scraping”).

7. Fees and Payment (If Applicable)

Certain aspects of the Service may be provided for a fee or other charge. If you elect to use paid aspects of the Service, you agree to the pricing and payment terms, as we may update them from time to time. CULTURECAST may add new services for additional fees and charges, or amend fees and charges for existing services, at any time in its sole discretion. 8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Service or contact us. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Disclaimer of Warranties; Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the Service is at your sole risk. To the fullest extent permissible by law, CULTURECAST and its affiliates, licensors, officers, directors, employees, agents, and suppliers disclaim all warranties, express or implied, in connection with the Service and your use thereof.

In no event shall CULTURECAST, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which CULTURECAST is established (details may vary by region or plan, to be specified in specific agreements if necessary), without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
